Benner Township Zoning & Permits
A Zoning Permit ensures that the structure you want to build is permitted in the Zoning District where you wish to build. Also ensures setback requirements are met.
A Zoning Permit is required in Benner Township prior to any of the following activities:
- the alteration, addition or erection of any building or portion thereof;
- the use or change in use of a building or land; and
- the change or extension of a nonconforming use.
It shall be unlawful for any person to commence work for the erection or alteration of any building or for a change in land use until a permit has been issued. Ground mounted solar requires Conditional Approval.
Building Permit
To apply for Building Permit in Benner Township, you first MUST obtain a Zoning Permit and provide three (3) sets of plans, and have the following (if required):
- A Sewage Permit (required in new construction or renovation adding bedroom(s).
- A Highway Occupancy Permit -from the Roadmaster (any time a driveway is added, or when required by Centre County).
- A map/sketch of the site plan/plot plan with distances from the property lines.
Penns Valley Code Enforcement Agency and Keystone Inspection Agency is authorized by Benner Township to issue the Township Building Permits
Sign Permit
Signs are not permitted in the Right of Way. For signs on a PA State roadway, approval from PennDOT is required
Peddler’s Permit
A Peddler’s Permit is required in Benner Township (see ordinance for specific details)
Ordinance Questions
Benner Township has a Zoning Ordinance as well as other stand-alone Ordinances.
Zoning Officer
The Zoning Officer reviews zoning applications for compliance with the Township’s Zoning Ordinance. The Zoning Officer may issue a zoning permit for all “by right” uses. The Zoning Officer acts as a consultant to the Supervisors and Zoning Hearing Board for conditional uses requests and special exception use requests, respectively, for those Board’s determinations. The Zoning Officer also investigates possible violations of the zoning ordinance when a complaint has been filed. This includes an on-site investigation and determination of whether a violation exists and then acting in accordance with the requirements of the ordinance and the Second Class Township Code. Most violations are resolved without the issuance of a fine.
