Act 13

Pennsylvania Act 44 of 2009, also known as the Pension Reform Act, requires Pennsylvania Act 13, also known as the Impact Fee, is a law that requires counties to impose an unconventional gas well fee and distribute the funds to local and state governments. The law was passed in 2012 and is administered by the Pennsylvania Public Utility Commission (PA PUC).

Counties can impose the fee if unconventional gas wells are located within their borders and they pass an ordinance within 60 days of the law’s effective date. Operators must pay the fee by April 1 of each year, and the revenue is distributed to local communities and state agencies by July 1.
