Act 44
Pennsylvania Act 44 of 2009, also known as the Pension Reform Act, requires contractors to disclose information annually to their public sector clients if they have a professional services contract with a municipal pension fund. The disclosure form is intended to identify potential conflicts of interest and provide information about financial relationships between the contractor and the municipality’s elected and appointed officials. The form must be posted on the municipality’s website and updated annually for the duration of the contract.
The disclosure requirements apply to contractors who provide professional pension services, such as actuarial or investment advisory services, and receive payment from the pension fund. The form asks contractors to identify the municipal pension system(s) they are providing information for, including non-uniform plans, police plans, and fire plans.
